Privacy Policy

In accordance with the legislation and regulations applicable to the protection of personal data, notably European Regulation No. 2016/679 of April 27, 2016, on the protection of individuals with regard to the processing of personal data ("GDPR"), as well as the French Data Protection Act which transposes it into French law, the personal data entrusted by the Client to BHR AVOCATS AARPI is afforded the highest level of protection.

 

Data Controller

The Client is informed that the data controller is BHR AVOCATS AARPI.

 

Types of Collected Data

The personal data concerned generally includes personal details (name, surname, date of birth, email address, postal address, profession, etc.), as well as any information the Client chooses to provide to BHR AVOCATS AARPI for processing the files entrusted to them.

 

Purpose of Processing and Legal Basis

This personal data is processed exclusively (i) for the needs of the cases entrusted to BHR AVOCATS AARPI and (ii) for billing purposes.

The legal basis for processing is both the Client’s consent to provide the relevant data and the service agreement and/or representation mandate that the Client enters into with BHR AVOCATS AARPI in the form of a fee agreement.

 

Recipients of the Data

This personal data is intended for BHR AVOCATS AARPI. However, it will be shared, for the strict need of the cases, with the following third parties: (i) in the case of litigation, with the opposing party (including their lawyer) and the jurisdiction handling the case, as well as with certain legal auxiliaries (bailiffs, experts, etc.); (ii) in the context of advisory services, if necessary, with organizations that BHR AVOCATS AARPI will be required to contact to comply with the Client’s instructions.

 

International Data Transfers

The Client is informed that the personal data entrusted to BHR AVOCATS AARPI may be transferred abroad, including to the United States of America, a country that does not have data protection legislation deemed "adequate" by the European Commission.

 

However, such transfers are only made for the purposes of processing the Client's files, to companies that have formally committed to respecting the privacy and personal data of their clients.

 

Data Retention Period

Personal data concerning the Client will be retained for the duration of the fee agreement, subject to mandatory provisions regarding the retention of accounting documents. In any case, the Client is free to request the return of all personal data concerning them held by BHR AVOCATS AARPI at any time. Such a request will, however, imply the termination of the fee agreement and, consequently, the firm’s representation.

 

Client Rights

BHR AVOCATS AARPI reminds the Client that they have the right to request access to their personal data, as well as the rectification or erasure of such data, the limitation of processing concerning their data, and the right to object to processing. However, in the case of limiting or objecting to processing, BHR AVOCATS AARPI will no longer be able to process the Client’s file, which will lead to the termination of the fee agreement.

The Client is also informed that they have the right to request the portability of their personal data. This right can be exercised by requesting the transfer of the relevant files to a new lawyer.

Finally, the Client is informed that they have the right to file a complaint with the Commission Nationale de l'Informatique et des Libertés (CNIL) regarding the collection and/or processing of their personal data by BHR AVOCATS AARPI.
